207 Overland Membership By-Laws
Article 1: Name
This organization shall be known as 207 Overland.
Article II: Purpose
SECTION 1. 207 Overland shall be oriented towards the gathering of overland enthusiasts on the Internet and at facilitated meetings and/or events. 207 Overland cannot discriminate or keep anyone from becoming a member because of sex, color, race, creed, religion, financial or social status. SECTION 2. Off-highway events and the organization thereof are one aspect of 207 Overlands activities but will not be 207 Overlands sole endeavor.
SECTION 3. 207 Overland will provide its community with operating structure to facilitate technical overland discussion regarding the following:
SECTION 4. 207 Overland will make efforts to improve the overall status of our hobby through development of better public image and association with individuals who are interested and active in the hobby.
SECTION 5. 207 Overland shall offer its volunteering efforts to other non-profit, charitable, and public/government organizations.
SECTION 6. 207 Overland will endorse the ideals and promote the off- highway practice of “Tread Lightly”.
Article III: Membership
SECTION 1. 207 Overland is interested in responsible overland enthusiasts who want to participate in overland related events and uphold our standards.
SECTION 2. Membership is not transferable and all incurred membership fees are nonrefundable.
SECTION 3. Memberships will only be accepted if they follow the proper 207 Overland membership procedure.
SECTION 4. Each membership is not limited to a vehicle but is by individual and immediate family.
SECTION 5. Sponsor Membership will be defined by the current sponsorship programs.
SECTION 6. 207 Overland reserves the right to reject any paid membership, renewal or online membership and associates at its discretion.
SECTION 7. All members and guests agree to conduct themselves in a respectable manner during any activities and online.
SECTION 8. Any person leaving under unfavorable conditions may be asked to return all evidence of 207 Overland membership.
SECTION 9. All members and guests shall be bound by these bylaws.
SECTION 10. Once a member is considered to be in good standing the following rights and benefits according to membership level chosen shall be extended to him/her as a 207 Overland member:
ARTICLE IV: DUES
SECTION 1. Membership dues are set at $35 for silver, or $180 for platinum, each per year and covers membership for a period of 12 months from the renew/join date. For instance, a new member joining on May 24 will be paid in full until the following May 24. It is the members responsibility to renew dues.
SECTION 2. No portion of the dues will be refunded if a member chooses to leave or membership is revoked by 207 Overland. If any issues arrive from electronic membership renewals 207 Overland has discretion for refunds.
SECTION 3. Dues, membership fees, or any existing extraneous charges will be subject to change due to an increase in operating costs or for any other reason deemed necessary by 207 Overland.
ARTICLE V: QUALIFICATIONS OF MEMBERSHIP AND EVENT PARTICIPATION
SECTION 1. To qualify for membership, a potential member or immediate family member must legally own an “overland” vehicle.
SECTION 2. All members must possess documentation showing proof of age, proof of driver’s license, and vehicle insurance and have written parental consent if under age 18.
SECTION 3. Prospective member must submit membership fee with a completed application form.
SECTION 4. Sponsor Application – Sponsorship approved by 207 Overland and sponsorship programs will include at least one general membership for the term of the sponsorship contract.
ARTICLE VI: FISCAL YEAR
SECTION 1. The fiscal year shall begin in January and end in December.
SECTION 2. 207 Overland shall accept dues to be placed in an account for disbursement to carry out the purposes of the organization during the fiscal year.
ARTICLE VII: MEMBERSHIP ACCESS
SECTION 1. All platinum members will have access to free Premier Trips, gps mapping service, and any other exclusive offering 207 Overland chooses to introduce. 207 Overland reserves the right to change included programs at any time.
ARTICLE VIII: Leadership
SECTION 1. 207 Overland is directed at the sole discretion of its founder and president. In addition, a team of Ambassadors and Trail Masters serves as leadership for 207 Overland and works with the founder to create trips, events, and moderate it’s members and online forums.
ARTICLE IX: RULES AND POWERS OF 207 OVERLAND
SECTION 1. 207 Overland and it’s founder shall have the power to manage all affairs of the organization on any and all questions relating in any manner whatsoever to the organization and community, and to make all contracts necessary for the proper transactions of all business. They shall have entire jurisdiction over all matters pertaining to the care, conduct, control, supervision, and management of the organization and its finances and they shall make all appropriations.
SECTION 2. It shall be the duty of 207 Overland to prescribe and publish rules regulating any future use and occupancy of the future offices of the organization, and the care and protection of its property.
SECTION 3. 207 Overland shall have the following specific powers:
ARTICLE X: DUTIES OF LEADERSHIP AND AMBASSADORS
SECTION 1. FOUNDER. The founder shall be the principal executive officer of the organization and shall in general supervise and control all the business and affairs of 207 Overland. He shall preside at all meetings of 207 Overland. He may sign any deed, mortgage, bond, contract, or any other instrument which 207 Overland, these bylaws, or statue requires. In general, he shall perform all duties incident to the office of founder and such other duties as may be prescribed by 207 Overland from time to time.
SECTION 2. In absence of the founder or in the event of his inability to act, an Ambassador chosen by order of tenure shall temporarily perform the duties of the founder, and when so acting shall be subject to all restrictions upon the president. He/she shall maintain the bylaws of 207 Overland. The Ambassadors shall perform such other duties as from time to time may be assigned to him/her by the founder of 207 Overland.
SECTION 3. Ambassadors/Trail Masters. The Ambassadors and Trail Masters are responsible for leading (or assigning leaders) and planning any 207 Overland sanctioned OHV activities. He/she will negotiate relationships with landowners, governmental agencies, proprietors, public officers, and any third party he chooses or is deemed necessary by the 207 Overland in order to help protect our ability to overland in designated areas and perhaps gain access to new sites. The Ambassadors and Trail Masters will also be responsible for the general trail leadership of and have custody over the safety requirements for the organization. He/she will advise on mechanical requirements, driver experience, safety equipment, and liability requirements and will promote-and enforce required equipment and required safety equipment lists. He/she will exemplify tread lightly philosophy to the membership and assist in educating membership about tread lightly principles. In general, he/she will perform all duties and any other such duties as from time to time may be assigned to him/her by the founder of 207 Overland.
ARTICLE XI: OFFICIAL EVENTS AND TRIP RULES
SECTION 1. To be recognized as an official 207 Overland event it must be announced to the general membership as such and all details regarding the proposed event must be made available to the general membership.
SECTION 2. To be recognized as an official 207 Overland event there shall be one Ambassador, Trail Master, or the Founder present at all times. Small, informal, get-togethers, and pop-up runs are encouraged by 207 Overland but are not to be considered official events of 207 Overland.
SECTION 3. Events will be planned by the leadership and regulated by the founder when necessary.
SECTION 4. All events are planned with safety as a primary factor; therefore, all events and participants in the event are subject to liability releases.
SECTION 5. The Founder shall have the ultimate decision-making authority for go/no go event decisions.
SECTION 6. The Ambassadors and Trail Masters will inform the founder about current trail conditions, vehicular compliance, weather precautions, or any other issue that might influence the decision making for the event.
SECTION 7. If an ambassador, trail master or the founder fails to show up to any official trip, event, or premier ride, it is therefore canceled as an official 207 Overland event. Any further activity by members, guests, or others shall no longer be considered official nor will this activity be affiliated with 207 Overland. An event may also change from official to unofficial at any time, and for any reason including while in progress. Reasons can include unplanned additions/exclusions to the itinerary, changes in attendance, or any other reason deemed necessary at any time.
SECTION 8. Events shall consist of off- highway trail rides and any other 207 Overland designated activities.
SECTION 9. An event shall begin at the conclusion of a pre-run driver’s meeting or functional equivalent and concludes when the group or groups have returned to a designated location.
SECTION 10. In the event of multiple day events the procurement of accommodations is the sole responsibility of the participant and not considered a portion of the event. The event itself is limited to the organized trail ride or other designated activity.
SECTION 11. Any measures taken by 207 Overland to acquire, provide, reserve, or guarantee accommodations are done solely as a service to the participants and are still not to be considered a part of the event.
SECTION 12. Each participant shall be held responsible and liable for his/her own safety and the safety of the participant’s minor children and any personal property. Concerns about safety should be brought to the attention of the trip leader or designated officer immediately, if possible before becoming trail bound.
SECTION 13. Any member bringing a guest along to an event is responsible for that guest’s safety. If the guest is under the age of 18, he/she must have written permission from their parent or guardian, unless they are attending a show and are not participating.
SECTION 14. All event member participants and their guests shall obey the 207 Overland rules of trail conduct as listed in this article, all applicable laws of the county and state that event is in, and any subsequent rules of landowner if event is held on private property. Anyone not conforming to these rules will be asked to leave the group.
SECTION 15. Participants may bring pets to events but with the understanding that they will be expected to keep their pets under control and behaved at all times. The behavior and any damage or injury caused by the pet will remain the sole responsibility of its owner. 207 Overland reserves the right to prohibit any or all pets to 207 Overland events.
SECTION 16. Profane language, when used at event, must be used with the utmost discretion. Please keep in mind that 207 Overland official events are meant to be family oriented and as such there is the likelihood that young children may be present.
SECTION 17. Any person behaving or operating their vehicle in an unsafe, rude, or negligent manner shall be asked to leave the event and will forfeit their attendance as well as any costs of membership or incurred for the event.
SECTION 18. There will be zero tolerance for consumption of alcohol and use of any sort of illegal substance while out on trails.
SECTION 19. Illegal possession of firearms during a sponsored event is strictly prohibited.
ARTICLE XII: Legal Notice
The organization and anyone leading any ride or event on its behalf will be excluded from any and all legal responsibility due to the actions of any member or guest during any ride or special event by way of a signed waiver. By signing a waiver, the singed takes full personal and legal responsibility for any action, incident, or damage that may happen during any 207 Overland event.
ARTICLE XIII: HAVING FUN!
Don’t forget to have fun and enjoy yourself. This organization is not worth doing or having if we are not having fun in the process. Do not let it become a chore.
